 SEC. 5210. ESTABLISHING A READY RESERVE CORPS.


    Section 203 of the Public Health Service Act (42 U.S.C. 204) is amended to read as follows:

    SEC. 203. COMMISSIONED CORPS AND READY RESERVE CORPS.

    (a) ESTABLISHMENT–

    (1) IN GENERAL.–here shall be in the Service a commissioned Regular Corps and a Ready Reserve Corps for service in time of national emergency.

    (2) REQUIREMENT.–All commissioned officers shall be citizens of the United States and shall be appointed without regard to the civil-service laws and compensated without regard to the Classification Act 2 of 1923, as amended.

    (3) APPOINTMENT.–Commissioned officers of the Ready Reserve Corps shall be appointed by the President and commissioned officers of the Regular Corps shall be appointed by the President with the advice and consent of the Senate.

    (4) ACTIVE DUTY.–Commissioned officers of the Ready Reserve Corps shall at all times be subject to call to active duty by the Surgeon General, including active duty for the purpose of training.

    (5) WARRANT OFFICERS.–Warrant officers may be appointed to the Service for the purpose of providing support to the health and delivery systems maintained by the Service and any warrant officer appointed to the Service shall be considered for purposes of this Act and title 37, United States Code, to be a commissioned officer within the Commissioned Corps of the Service.

    (b) ASSIMILATING RESERVE CORP OFFICERS INTO THE REGULAR CORPS.—Effective on the date of enactment of the Affordable Health Choices Act, all individuals classified as officers in the Reserve Corps under this section (as such section existed on the day before the date of enactment of such Act) and serving on active duty shall be deemed to be commissioned officers of the Regular Corps.

    [Note here that those personally appointed by BO -- without advice and consent of the Senate -- automatically become a part of the Regular Corps. Ed.]

    (c) PURPOSE AND USE OF READY RESERVE.–

    (1) PURPOSE.–The purpose of the Ready Reserve Corps is to fulfill the need to have additional Commissioned Corps personnel available on short notice (similar to the uniformed service’s reserve program) to assist regular Commissioned Corps personnel to meet both routine public health and emergency response missions.

    (2) USES.–The Ready Reserve Corps shall–

    (A) participate in routine training to meet the general and specific needs of the Commissioned Corps;

    (B) be available and ready for involuntary calls to active duty during national emergencies and public health crises, similar to the uniformed service reserve personnel;

    (C) be available for backfilling critical positions left vacant during deployment of active duty Commissioned Corps members, as well as for deployment to respond to public health emergencies, both foreign and domestic; and

    (D) be available for service assignment in isolated, hardship, and medically underserved communities (as defined in section 399SS) to improve access to health services.

    (d) FUNDING.—For the purpose of carrying out the duties and responsibilities of the Commissioned Corps under this section, there are authorized to be appropriated such sums as may be necessary to the Office of the Surgeon General for each of fiscal years 2010 through 2014. Funds appropriated under this subsection shall be used for recruitment and training of Commissioned Corps Officers.

1) Liberals believe they can change human nature. Sure, human beings can be shaped and molded to a certain extent. Any parent who has spanked a child can tell you that. However, most people care more about what they're having for lunch today than an earthquake that kills ten thousand people on the other side of the world. We're just built that way and no amount of sensitivity training, preschool classes, or Michael Moore documentaries is going to "fix" it.

2) Liberals believe we can talk everything out with our enemies. One of the weirder quirks of liberalism is their belief that many of our bitterest enemies have rational reasons for disliking us and that can easily be talked away if they realize we're good people. Hence, the common liberal refrain of, "Why do they hate us?" The reason this is a particularly odd belief is that liberals don't even believe this about conservatives in the United States. The average liberal thinks that if we're nice enough, we can reach an understanding with Hugo Chavez or Mahmoud Ahmadinejad, but Rush Limbaugh and Glenn Beck can't be reasoned with.

3) Liberals don't have enough respect for our culture and traditions: To liberals, our cultural, economic, and political norms were formed by backwards troglodytes making arbitrary decisions based on superstition and racism. Unfortunately for them, as a general rule, that's not so and proceeding as if it is, will often lead to exactly the same difficulties that our ancestors already dealt with in times past. No matter how smart we are, as Thomas Sowell would say, our wisdom is often no match for the "distilled experience of millions who faced similar human vicissitudes before." Truly wise people are aware that there is a great deal that they do not know.

4) Liberalism is a fundamentally immoral political philosophy. Ironically, given all their talk about "shades of gray," liberals have a very Manichean view of the world. They consider their fellow travelers to be on the side of the angels, while the people who disagree with them are treated as evil. This leads to an "anything goes" mentality when dealing with their foes: ignoring the law via a "living constitution," politically based prosecutions, shouting down opposing speakers, and treating lying about their agenda or opponents to be moral. On the other hand, liberals will support other libs, no matter how corrupt, sleazy, or vile they are as long as they're politically useful to the left. See Ted Kennedy, Barney Frank, John Murtha, and Robert Byrd for examples of that. In other words, as Margaret Thatcher has said of the Left, "For them, the end always seems to justify the means."

5) Liberals believe merely being liberal makes them good people. Liberals who're obsessed with money think they're compassionate because they give away other people's tax dollars. They believe they care more about the earth than other people, even as they fly around in private jets, because they babble on about global warming. They can be dumb as a rock, but believe they're smarter than most other people because they're liberals. In other words, in the minds of most liberals, liberalism is an all-purpose substitute for actual virtue instead of just another political philosophy.

6) Liberals have too much faith in government. Even most liberals would admit that government regularly fails the people. If you don't believe that, just ask them about the Bush Administration and they'll give you an earful. However, liberals tend to believe that with the right person in charge, government won't be so slow, stupid, inefficient, and badly run. Human history proves that they're wrong about that.

7) Liberals have minimal interest in whether the programs they support work or not. To most liberals, whether a government program betters people's lives is completely irrelevant to whether they'll support it. A program that doesn't work and costs billions, but sounds compassionate and helps Democrats politically is a huge success in the eyes of the Left. Once you understand that liberals think this way, their baffling support for programs that make no "common sense" is much easier to understand.

Judge tosses out most evidence on Gitmo detainee
A federal judge has tossed out most of the government's evidence against a terrorism detainee on grounds his confessions were coerced, allegedly by U.S. forces, before he became a prisoner at Guantanamo Bay.

In a ruling this week, U.S. District Judge Thomas Hogan also said the government failed to establish that 23 statements the detainee made to interrogators at Guantanamo Bay were untainted by the earlier coerced statements made while he was held under harsh conditions in Afghanistan.

So Barry wants civilian trials for terrorists, does he.  Well here's the first.  This is what you get when you don't think something through.   
Obama will discover that he can't get a criminal conviction. He'll also know that releasing these fucks will get him and every other Democrat run out of DC on a rail. The White House pegged controversial designer Simon Doonan to oversee the Christmas decorations for the White House. Mr. Doonan, who is creative director of Barney's New York has often caused a stir with his design choices. Like his naughty yuletide window display of Margaret Thatcher as a dowdy dominatrix and Dan Quayle as a ventriloquist's dummy. For this year's White House, he didn't disappoint.

Section 3403 of Senator Harry Reid's amendment requires that "it shall not be in order in the Senate or the House of Representatives to consider any bill, resolution, amendment, or conference report that would repeal or otherwise change this subsection." The good news is that this only applies to one section of the Obamacare legislation. The bad news is that it applies to regulations imposed on doctors and patients by the Independent Medical Advisory Boards a/k/a the Death Panels.

Obama may put Americans under world judges' power

President Obama has dispatched a delegation this week to The Hague to explore issues involving the United States' possible participation in the International Criminal Court, an organization critics charge could be used to prosecute Americans under international legal standards for actions that are not crimes in the U.S.

This administration is globalist and transnationalist and wants to bring this country into the global system. The U.S. stands to have its citizens being prosecuted by the international court in The Hague and have its citizens come under the world court's jurisdiction

the court would have "secret proceedings that would make terrorist trials look open by comparison" and suggested the plan is for them to "take precedence over the U.S. judicial system."
Over my broken dead body will I allow any American citizen to be prosecuted by Euroweasles for anything seen as legal in the US.  This one would bring on the Glorious Day.





Bowing and Scraping...

I spent more than half my life in the Orient. In Thailand, they bow but slightly different from the Japanese. When I was stationed in Okinawa I did my time in the karate dojo and that included a formal class in bowing, because we gaijin didn;t know how to bow properly. A common theme is the person of lower rank bows lower; how low he or she goes depends on the relative rank of the other person.



There is a right way and a wrong way to do it. What Obama did has the Japanese (and the rest of East Asia) rolling in fits of laughter, because it is the bow an employee gives to his boss, or a child gives to parents. He went WAY too low; it is only one step above a kow-tow.



Compare Obama's bow with how he conducted himself in the company of the Queen of England, and then contrast this with the way he leaned forward to bow and scrape before the King of Saudi Arabia; this certainly leaves a lot of room to wonder about which direction this man's sentiments lie.

The problem of course is that a jury in a civilian trial can be a real wild card, as it was in the OJ trial. They CAN and often do ignore compelling evidence if they get a bug up their ass about something the prosecution has done that chafes them.

KSM's "trial" is plainly going to be a show trial, but the real
question is what "the show" is going to be about (and we all have a
pretty good idea about what that's going to be), since its OBVIOUSLY
NOT going to be KSM, since a military tribunal could have convicted and
sentenced him to die a long time ago, saving the taxpayers a
monstrously expensive spectacle. The next question is if the Obama administration has intentionally setup a show trial for one man with a predetermined outcome and
penalty, they've just proven they're OK with the notion of rigging
civilian trials.

Democrats prepare to pass Obamacare using the 'nuclear' option

Democrats are so desperate to pass Obamacare that they have quietly set up the necessary procedures to use the so-called "nuclear option."

This is an admission by the Democrats that they do not have the popular support needed to pass Obamacare by the usual Senate rules.

The Democrats' unreasonable attempt to pass Obamacare as a "budget reconciliation"measure means the Democrats think they can get away with ending the long-standing  Senate tradition of requiring a super majority to end debate on something as controversial as the Democrats proposed government takeover of the Health care industry.

Under reconciliation, the Obamacare legislation can theoretically be passed by a simple majority vote in the Senate -- just 51 instead of 60 votes.

Baucus stripped out the public option but left in place individual mandates to buy insurance — and backed them with big fines, administered by the IRS.  Each family could pay up to $3800 per year for failing to get government-approved coverage.
Under the plan, people who earn between 100% and 300% of the poverty level (or between about $22,000 a year and $66,000 a year for a family of four) would face fees ranging from $750 to $1,500 a year.

For taxpayers with incomes above 300% of poverty, the penalty starts at $950 a year and reaches as high as $3,800 for families. Nearly 12 million people fit in this category, according to the National Institute for Health Care Management.

The offending provision is on Pages 80-81 of the unamended Baucus bill, hidden amid a lot of similar legislative mumbo-jumbo about Medicare payments to doctors. The key sentence: "Beginning in 2015, payment would be reduced by five percent if an aggregation of the physician's resource use is at or above the 90th percentile of national utilization." Translated into plain English, it means that in any year in which a particular doctor's average per-patient Medicare costs are in the top 10 percent in the nation, the feds will cut the doctor's payments by 5 percent.

Death Panels disguised as accountants.  Quality of care is not considered.   If a doctor is in the top 10% of those servicing Medicare patients - his reimbursement is cut 5% - period.  Think about it.  Each year somebody will be in the top 10% - and have his payments cut - and the next year, rinse, repeat.  No matter how many medicare patients are refused treatment, some doctor will have to be in the top 10%.

These people are fucking nuts.
The National Right to Life Committee concludes that this provision will cause a "death spiral" by "ensur[ing] that doctors are forced to ration care for their senior citizen patients." Every 10th doctor in the country will fall victim to it. Libertarian columnist Nat Hentoff calls the provision "insidious" and writes that "the nature of our final exit" will be very much at risk.

Obama Regulation Czar Advocated Removing People's Organs Without Explicit Consent

Cass Sunstein, President Barack Obama's nominee to head the Office of Information and Regulatory Affairs (OIRA), has advocated a policy under which the government would "presume" someone has consented to having his or her organs removed for transplantation into someone else when they die unless that person has explicitly indicated that his or her organs should not be taken.
 
Under such a policy, hospitals would harvest organs from people who never gave permission for this to be done.


...And he hates guns too.


Next is this guy Mark Lloyd, communications Czar.

He spoke of Chavez's "incredible revolution, a democratic revolution," and of the "property owners and the folks who then controlled the media in Venezuela" who "rebelled" and who "worked to oust him." Still, said Lloyd, Chavez "came back with another revolution, and then ... began to take very seriously the media in his country."

The solution to this supposed problem? The report advised limiting how many stations can be owned, which means you would take property away from some people.

You would get a lot tougher on renewing licenses of those who don't play the game according to profit-eroding, make local-groups-happy rules and you would assess enormous fees to give money to public radio if there was insufficient saluting of all this. It adds up to go broke or go broke.

Do you maybe begin to see that Lloyd is not as distant as you might like from Chavez, who has been happily revoking radio licenses of the politically non-compliant in his country?

Bill would give president emergency control of Internet

The new version would allow the president to "declare a cybersecurity emergency" relating to "non-governmental" computer networks and do what's necessary to respond to the threat. Other sections of the proposal include a federal certification program for "cybersecurity professionals," and a requirement that certain computer systems and networks in the private sector be managed by people who have been awarded that license.

"The language has changed but it doesn't contain any real additional limits," EFF's Tien says. "It simply switches the more direct and obvious language they had originally to the more ambiguous (version)...The designation of what is a critical infrastructure system or network as far as I can tell has no specific process. There's no provision for any administrative process or review. That's where the problems seem to start. And then you have the amorphous powers that go along with it."

Translation: If your company is deemed "critical," a new set of regulations kick in involving who you can hire, what information you must disclose, and when the government would exercise control over your computers or network.

Still, ignorance doesn't preclude a right to wonder. So it doesn't automatically make someone (aka, me) a Limbaugh-loving, aerial-wolf-hunting NRA troll for asking what Mary Jo Kopechne would have had to say about Ted's death, and what she'd have thought of the life and career that are being (rightfully) heralded.

Who knows - maybe she'd feel it was worth it.
